- In relation to each request to consolidate my super into my MLC account, I consent to MLC rolling over or transferring my super benefits to my MLC account and authorise the superannuation provider of each fund to give effect to this transfer.
- I consent to MLC rolling over or transferring to my MLC account the super I may have with the ATO.
- I authorise MLC to act on my behalf in arranging each rollover and transfer of super effected by MLC under this electronic facility. This includes disclosing my tax file number for the purposes of consolidating my account, and receiving information from other organisations.
- I acknowledge that the roll over or transfer of my super benefits to my MLC account can result in losses and damages, including (but not limited to):
(a) a reduction in my super benefits because my outgoing / transferring fund charged me fees on the rollover or transfer;
(b) a loss of my insurance cover in my outgoing / transferring fund;
(c) differences in fees and costs between my outgoing / transferring fund and my MLC account; and
(d) if I have not arranged for my employer to commence paying contributions to my MLC account.
- MLC confirms that:
(a) I am not liable for any losses or damages arising from:
(i) the fraud or negligence of MLC or its employees or agents;
(ii) MLC's system or equipment malfunctioning, including non-completion of rollovers and transfers and unreasonable delays in carrying out my valid instructions;
(iii) any unauthorised rollover or transfer where I have not contributed to such a loss; and
(iv) any unauthorised transaction occurring after I have told MLC that the security of my log-in details has been breached; and
(b) unless I have acted fraudulently in relation to a rollover or transfer, the maximum limit on my liability for loss or damage is the total value of my super benefits in the outgoing / transferring fund and my MLC account from time to time.
- I release MLC and its related bodies corporate from liability for any loss or damage arising from my use of this electronic facility, including indirect, special and incidental loss or damage, except for those losses and damages outlined in paragraph 4.
- I confirm that my use of this electronic facility does not constitute the provision to me of personal advice.
- I acknowledge that MLC cannot guarantee that all of my super accounts will be rolled over or transferred to my MLC account.
- I acknowledge that MLC will not implement, or will cease implementing at any time, a rollover or transfer if I have provided inaccurate information.
- If a rollover or transfer request is declined, I acknowledge that I will contact my outgoing / transferring fund for further details of why the rollover or transfer was declined.
- I discharge my outgoing / transferring fund of all further liability in respect of the super benefits paid and transferred to my MLC account.
- I declare that all information provided by me in relation to my request to consolidate my superannuation funds is complete and accurate.
- In these terms and conditions, "MLC" means NULIS Nominees (Australia) Limited ABN 80 008 515 633 and its related bodies corporate.
